Williams Montara HP003 – False and Unlawful Efficiency Claims
Williams markets the Montara HP003 using SEER and COP, not SEER2 or HSPF2. After January 1, 2023, this is unlawful for U.S. residential heat pumps.
Illegal Metrics Used
DOE regulations require that all residential heat pumps evaluated under AHRI 210/240 be certified and marketed using SEER2 and HSPF2, pursuant to the DOE Final Rule published December 30, 2021 (86 FR 74228), which adopted Appendix M1 to 10 CFR Part 430 with a mandatory compliance date of January 1, 2023.
The continued use of SEER and COP after that date is not permitted. COP is not an approved DOE efficiency metric for residential heat pumps, and SEER is obsolete and legally invalid.
False and Unsupported Efficiency Claims
The Montara HP003, manufactured by Zymbo, does not achieve the efficiency levels implied by its published SEER and COP ratings when tested under the mandatory DOE test procedure. Those published values are unsupported by any valid DOE-compliant laboratory testing and cannot translate to compliant SEER2 or HSPF2 ratings.
Federal law prohibits any efficiency representation unless it is based on the DOE-prescribed test procedure and forbids the distribution of covered products that are not properly certified. 42 U.S.C. § 6302; § 6302(a)(5).
Consumer Harm
Because the Montara HP003 is marketed with non-compliant and inflated efficiency metrics, consumers are misled and incur higher electricity costs than they would have with a lawfully tested and accurately rated product.
